Course objectives
The public interest is an aspect that affects the legislative process in all areas of law. In private international law, aside from the rule-making process itself, the public interest is reflected both by several basic institutes of conflict-of-law area of private international law and within the process of recognition and enforcement of foreign judgment. It is an orde public, overriding mandatory rules or materialization of the conflict solution. Due to the broad scope of the issue, it is divided between two semmestr of studies. The aim of this course (first semmester) is to analyze the key parameters of overriding mandatory rules and materialization of the conflict solution, including manifestations and impacts on private relations with an international element. Institutes will be analyzed by the perspective of the process of application of foreign law, ie at what moment and in what way these institutions can be used. Given the public nature of mandatory standards, the way in which they are taken into account in resolving a dispute over a private law relationship will be analyzed.
Learning outcomes
Students will be able to identify and characterize overriding mandatory rules, safety rules and materialization of the conflict solution. They will be able to explain and determine the reasons for using these institutes, the moment of their use in the process of application of foreign law and the impact on the private relationship with the international element.
