Course objectives

The course is focused on legal science: on approaches identifying the conditions under which legal science can be spoken, particularly with regard to general concepts of science, taking into account the specific issues of the field of law. The course also introduces the basic concepts of legal science (and science in general). Another important subject of the course is legal methodology, ie the characteristics of legal methodology, possibilities and limits of legal methodology, as well as basic principles, including principles of scientific ethics (including the so-called prevention of errors). In this context, the course will also introduce the division of scientific methods, with emphasis on the requirements and practice of legal science (ie doctrinal research and empirical research). In this part the course will introduce classical doctrinal approach, qualitative research (legal anthropology, legal ethnology, etc.) and quantitative research (Law and Economics, legal sociology, etc.)

Learning outcomes

After completing the course student: can characterize legal science and identify its specifics, is skilled in concepts of legal science, can use legal methodology and defend individual steps of his research, can distinguish (in a specific context) individual methodological approaches in legal science, can reflect basic methodological errors in legal science.

Syllabus

• The course is to be divided into four thematic blocks: 1) science and legal science, basic concepts of legal science (and science in general). 2) legal methodology, possibilities and limits of legal methodology, basic principles, including principles of scientific ethics, division of scientific methods, with emphasis on the requirements and practice of legal science (ie doctrinal research and empirical research). 3) classical doctrinal approach, 4) qualitative research (legal anthropology, legal ethnology, etc.) and quantitative research (Law and Economics, legal sociology, etc.)
