Cíle předmětu
At the end of the course students should be able to:
a) Understand and explain the interconnections between Traditional Knowledge and Folklore, on the one hand, and Patents, Copyright, Trademarks, Geographical Indications and Industrial designs, on the other hand.
b) Establish skills in developing national strategies on Intellectual Property, Traditional Knowledge and Folklore
c) Make reasoned decisions concerning Alternative Dispute Resolution for disputes related to Intellectual Property, Traditional Knowledge and Folklore
Osnova
  • 1. Traditional Knowledge, Traditional Folklore and Intellectual property - Introduction and Overview: Looking at an attempt to define Traditional knowledge (TK) and Folklore; then tracing the growing relationship between TK and Folklore, and Intellectual property (IP) law.
  • 2. Development of National Strategies on IP, TK and Folklore: Exploring the meaning of ‘Protection‘; then looking at policy initiatives, legislative initiatives, infrastructure and practical tools. These provide the basis for development of a comprehensive protection strategy for TK and Folklore.
  • 3. a) Intellectual Property and Arts Festivals; and, (b) Intellectual Property and Traditional Handicrafts: These sub-components rely on case studies to look at the use of key IP areas such as copyright and related rights, brands and trademarks in the protection of TK and Folklore to certain extents.
  • 4. a) Intellectual Property and Traditional Medical Knowledge; and, b) Customary Law and Traditional Knowledge: These sub-components also rely on case studies in addressing protection of Traditional Medical Knowledge. Consideration is also given to legislative and practical options, inclusive of customary law.
  • 5. Alternative Dispute Resolution (ADR) for disputes related to Intellectual Property and Traditional Knowledge and Folklore: Under this topic, consideration shall be made of advantages in the use of ADR and the potential challenges involved.
  • 6. Documentation of Traditional Knowledge and Folklore (Traditional Cultural Expressions): This addresses issues such as the need for safeguarding and preserving the cultural heritage and mechanims for the documentation of TK and Folklore.
