Introduction: Welcome to Torts. This course will introduce you to the continually evolving field of civil wrongs that justice and society have decided are deserving of monetary compensation. Class Participation: Having trained and taught in the Socratic-class-discussion-style, I will encourage you to participate in class. I also reserve the right to terminate the discussion at any time if time does not permit.

  • Class #2 Six Perspectives on Tort Law and One Very Hot Cup of “McCoffee”
  • Class #3 Intentional Torts (Meaning of Intent, Battery, Assault, False Imprisonment, Outrage, Trespass, Conversion and others)
  • Class #4 Defenses to Intentional Torts (Consent, Self-defense, Defense of Others, Defense of Property, Necessity, Justification)
  • Class #5 Negligence and the Standard of Care (Prima Facie Case, The Reasonable Person, Custom, Res Ipsa Loquitur)
  • Class #6 Causation (Tests of Causation in Fact)
  • Class #7 Proximate or Legal Causation, Intervening Causation

Class Format and Assignments: My philosophy is to make the classroom experience as enjoyable as possible, while expecting competence and excellence from my students. Class sessions will include some lecture, some obligatory "war stories," and some class discussion of the reading assignments. Reading assignments will be mostly from citations to the internet. The following is the estimated schedule of reading assignments for the term. Our pace through the assignments may vary depending on the material and the nature of the class discussion. Any changes or additions to the schedule will be announced in class.
Assessment methods
Grading & Attendance: Your grade will be determined by a final examination. The exam will cover only the materials that I lecture on in class, thus class attendance is important.
