Abstract

Text se věnuje současnému navrchu Zákonu o sociálně-právní ochraně dětí vůči nedostatečné míře jeho důslednosti v řešení klíčových výzev implementací práv dětí. Přesně, mizery včasného zasahování do rodin, monitorování služeb, soustředění na zájmů rodiny a standardy náhradní péče se považují za důsledky nerovnováhy mezi bezpečí dítěte a autonomií rodin. Rozpaky mezi postupem rozhodování a následujícím umístěním dítěte do péče se považují za zásadní barieru zlepšení procedur a kritérií, jimiž se řídí ochrana dětí. Česká situace se probíraje ve srovnávacím kontextu jak zemí Visegrádu, tak i mezinárodních standardů.

Abstract (in English)

The text revises the current draft of the Law about child protection in order to recognise the main challenges of contemporary system of services aimed at implementing children’s rights. Precisely, the shortcomings of on-time intervening with families, monitoring under services, family-based approach, and the standards of child’s placement are attributed to the lack of the balance between child safety and family autonomy. The discontinuity between the approach to decision-making and further placement is viewed as the key obstacle for refining procedures and criteria managing child protection. The issues of the Czech child protection are built into the comparative contexts regarding both Visegrad countries and international standards.
