Abstract
This contribution deals with two most usual models of legal reasoning practised in legal reasoning in adjudication: linear and dialectic reasoning. These approaches are compared and evaluated from the point of view of most essential legal values (justice, legal certainty).

Tento příspěvek se zabývá dvěma v aplikační praxi nejobvyklejšími argumentačními přístupy: lineární a dialektickou argumentací. Tyto přístupy jsou porovnávány a hodnoceny z pohledu nejdůležitějších právních hodnot - spravedlnosti a právní jistoty.
