Abstract

Abychom náležitě porozuměli základním konceptům, na kterých stojí současné ústavní demokracie, je třeba pro studium těchto konceptů zvolit jak genealogickou, tak architektonickou perspektivu. Tento článek představuje druhý díl rozsáhlejšího intelektuálního projektu zaměřeného na koncept suverenity. Pojednává o historickém a konceptuálním vývoji od právního konceptu suverenity ke konceptu suverenity lidu, jež je matricí současných debat o tomto nárožním kameni budovy moderních právních a politických systémů. V první části článek zkoumá především myšlenku reprezentace, vytvořenou anglickým filosofem Thomasem Hobbesem. Ve své druhé části je stopován proces vynalézání moderního konstitucionalismu. Vrcholem článku je analýza díla francouzského konstitucionalisty abbé Sieyese, prvního velkého teoretika konceptu konstitutivní moci.

Abstract (in English)

To properly understand the basic concepts of contemporary constitutional democracies, it is necessary to study them from both the genealogical and architectonic perspectives. This article is the second piece of a larger intellectual project focusing on the concept of sovereignty. It deals with the historical and conceptual development from the legislative conception of sovereignty to the concept of sovereignty of the people, which is the matrix of current debates about this cornerstone of modern legal and political systems. In its first part, the article specifically explores the idea of representation as it was coined by the English philosopher Thomas Hobbes. In its second part, the process of the invention of modern constitutionalism is thoroughly analyzed. The article approaches its climax in the analysis of the work of the French constitutionalist abbé Sieyes, who was the first big theorist of the concept of constituent power.
