The articel deals with Non-perfomance in New Czech Civil Code. Czech private law is nowadays preparing for a brand new concept. The NCC brings a complete change to the approach of not only rights in rem, e.g. by returning to the principle superficies solo cedit, but it significantly alters the law of contracts, in both a comprehensive change in the concept of legal act and changes of consequences for faulty performance (non-performance).
