Abstract

Tato učebnice diskutuje základní právní problémy práva Evropské unie v oblasti poskytování finančních služeb a finančního trhu. Vedle evropské úpravy zohledňuje také česká specifika. Zodpovídá na následující otázky: Za jakých podmínek je uzavírání smluv o finančních službách v České republice prostřednictvím internetu v souladu s právem? Jaké další požadavky jsou kladeny na poskytovatele? Počíná tedy diskuzí o klasickém způsobu sjednávání smluv o finančních službách, analyzuje úpravu poskytování služeb na vnitřním finančním trhu Evropské unie a zaměřuje se na specifika sjednávání a poskytování finančních služeb pomocí internetu a pomocí dalších obdobných technologií. Přílohami této učebnice za účelem zamyšlení se nad stávající právní úpravou jsou De Larosière Group Report (2009) a Liikanen Group Report (2012).

Abstract (in English)

This lecture book discusses basic legal problems of the European Union law in the area of financial services providing and in the area of financial market. It mentions the Czech specifics along with the European Union regulation. It answers the following questions: Which requirements has to be met during concluding financial services contracts concluding on the internet? Which other duties are required for the service providers? It starts with the discussion on classic methods of contracts concluding, analyzes the regulation of services providing on the European Union internal market and focuses on specifics of concluding and providing the financial services using the internet and other similar technologies. The attachments to this book are De Larosière Group Report (2009) a Liikanen Group Report (2012).
