Abstract

Při přípravě Ženevské úmluvě o právním postavení uprchlíků z roku 1951 (ŽÚ1951) měli zástupci států při formulování klíčové formulace v definici uprchlíka – „odůvodněného strachu z pronásledování“ – na mysli primárně pronásledování ze strany státu. Nicméně, od roku 1951 se důvody uprchlických proudů výrazně změnily a dnes většina žadatelů o azyl utíká před újmou způsobenou osobami či entitami, které nemají se státem nic společného. Není asi překvapením, že otázka původců pronásledování rozdělila smluvní strany ŽÚ1951 na dva tábory – státy, které závažnou újmu způsobenou nestátními subjekty považovaly za pronásledování ve smyslu ŽÚ1951 („lidskoprávní“ přístup) a státy, které zastávaly opačný výklad („odpovědnostní“ přístup). Tento výkladový problém byl v rámci Evropské unie definitivně vyřešen v tzv. kvalifikační směrnici. Kvalifikační směrnice však zdaleka neukončila debatu nad rolí nestátních subjektů v definici uprchlíka. Právě naopak. Kvalifikační směrnice sice nakonec přijala „lidskoprávní“ přístup k původcům pronásledování, ale zároveň zavedla nový pojem „nestátních poskytovatelů ochrany“. Mezitím se jádro sporu v rozhodovací praxi přesunulo od otázky původců pronásledování k otázkám požadované úrovně vnitrostátní ochrany, povinnosti vyhledat ochranu v zemi původu a možnosti vnitřní ochrany. Lze tedy konstatovat, že role nestátních aktérů v definici uprchlíka se nikterak nezmenšila, spíše naopak. Cílem této práce je postihnout tento trend a nastínit roli nestátních subjektů v definici uprchlíka v 21. století.

Abstract (in English)

In 2004, the EU member states adopted the so-called EC Qualification Directive which was supposed to end the bitter dispute regarding non-state agents of persecution, at least within the EU. But, the EC Qualification Directive has not been the end of the story. While it eventually opted for the ‘protection approach’ vis-a-vis the non-state agents of persecution, it simultaneously introduced a brand new concept of ‘non-state actors of protection’. In the meantime, the core of the refugee adjudication has shifted from the issue of agents of persecution to issues such as standard of state protection, exhaustion of remedies available in the country of origin and internal protection alternative. Therefore, the role of the non-state actors in the refugee law has not diminished. To the contrary, we are witnessing the reconceptualising and broadening of their role in the refugee adjudication. The aim of this book is to examine this trend. It focuses primarily on the ‘failure of State protection’ limb of persecution. More specifically, it addresses non-state agents of persecution, non-state actors of protection, the role of non-state actors in internal protection alternative, the concept of effective protection, the requirement of exhausting domestic remedies and the internal protection alternative.
