Abstract

Chápání účelu a smyslu práva a právní normy je součástí právně filosofických a právně teoretických úvah. Účel a smysl práva představuje interpretační nástroj, ať již z hlediska záměru zákonodárce, aktuálního účelu právní normy nebo úvah o ekonomických a sociálních důsledcích právní normy.

Abstract (in English)

Understanding of the purpose and sense of law and legal norm is a part of considerations of philosophically-oriented legal theory. Purpose and sense of justice is an interpretative instrument, whether in terms of intention of the legislator, the actual purpose of legal norm or of considering the economic and social consequences of legal norm.
