Abstract

Tato publikace se zabývá analýzou rozhodnutí Soudního dvora Evropské unie vztahující se k interpretaci termínů použitých v Nařízení Brusel Ibis (resp. Bruselské úmluvě a Nařízení Brusel I) v části týkající se mezinárodní příslušnosti (pravomoci) soudů členských států Evropské unie ve věcech občanských a obchodních. Pochopení konkrétního pojmu a jeho výkladu je nutné v podmínkách prohlubující se integrace a zesilujících pravomocí orgánů EU, zejména v oblasti justiční spolupráce v civilních věcech. Publikace je určena nejen pro výzkumné a teoreticko-pedagogické účely, ale také pro aplikační praxi. Je užitečným zdrojem informací pro advokáty, soudce a další, kteří se ve své činnosti zabývají spory s mezinárodním (přeshraničním) prvkem a otázkou určení mezinárodní příslušnosti (pravomoci) soudů.

Abstract (in English)

This publication analyzes the decisions of the Court of Justice of the European Union relating to the interpretation of terms used in the Brussels Ibis Regulation (resp. Brussels Convention and the Brussels I Regulation), in the area of jurisdiction of the courts of the Member States of the European Union in civil and commercial matters. To understand evolution of interpretation of particular term is necessary for the deepening integration within the EU, as manifested particularly in the area of judicial cooperation in civil and commercial matters. This publication is intended not only for research and theoretical teaching purposes, for students and lecturers, but also for practitioners - lawyers, judges and others who deal with disputes with the international (cross-border) element and the question of the determination of international jurisdiction of courts.
