Abstract

Článek se snaží odpovědět na otázky, jakým způsobem se změna společnosti promítla do civilních kodexů, tj. zdali jsou kodexy 19. století postavené na stejných hodnotách, jako kodexy vznikající ve 21. století. Stranou pozornosti nezůstane nový trend soukromého práva, který se projevuje ustanoveními prosazující a garantující ochranu slabších stran v soukromém právu a svým způsobem tak narušující stěžejní zásadu autonomie vůle.

Abstract (in English)

The author of the article focuses on a reflection upon the cha nging of society in civil codes, especially whether the codes adapted in the nineteenth c entury were based on the same values as those that are being drafted in the twenty-first century. The a uthor also analyzes a new trend in private law that typically guarantees the protection of weaker parties in p rivate law and, thus, interferes with the crucial principle of autonomy of will.
