Abstract

V originále

Ther text adresses possible causes that may justify state (regulative) intervention into competiton process. Whether it regards cartel law with its prohibitions of certain types of inter-firm cooperation, law against abuse of the dominant position, or whether it is merger control that is of concern, the key question is how and according to which criteria to distinguish practices that are natural and in fact indispensable for the effective competitive process, and which are, on the other hand, detrimental and constraining.
