Abstract

Předkládaný článek se zaměřuje na otázku vnitřních limitů ústavních demokracií, tj. téma, které by se mělo diskutovat dříve, než se začneme bavit o reálné či domnělé krizi středoevropských demokracií. Po krátké úvodní diskusi nad konceptem ústavní demokracie samotným článek ve své první části představuje koncepce ústavních limitů demokratických a konstitucionalistických teoretiků. V druhé části článek diskutuje pojem ústavního selhání při vytváření a udržování ústavních demokracií. Článek je v samotném závěru zakončen typologií vnitřních a vnějších limitů ústavních demokracií.

Abstract (in English)

The article looks at the inherent limits of constitutional democracy, i. e. the topic which should be discussed first when dealing with real or putative crisis of Central European democracies. After a brief introductory discussion of the very concept of constitutional democracy, it starts with the presentation of democratic and constitutionalist accounts of difficulties of constitutional democracy. Further, it discusses constitutional failure during the creation and maintenance of constitutional democracy. Finally, this exploratory article ends with a typology of internal and external limits of constitutional democracy.
