Abstract

V této práci se zabývám problematikou náhrady nemajetkové újmy způsobené nesprávným úředním postupem spočívajícím v nepřiměřené délce soudního řízení. Primárním cílem této práce je přehledné zpracování zvolené materie s ohledem na judikatorní závěry Evropského soudu pro lidská práva a Nejvyššího soudu České republiky. V práci rovněž poukazuji na závěry, které považuji za problematické a navrhuji vhodnější řešení. Týká se to např. odlišování mezi posuzováním existence nesprávného úředního postupu a určováním přiměřeného zadostiučinění (druhá kapitola), nebo také metody pro určení přiměřeného zadostiučinění (čtvrtá kapitola).

Abstract (in English)

In this paper, I explore the issue of compensation for non-material damage resulting from flawed clerical procedure involving the unreasonable length of legal proceedings. The primary aim of this paper is to provide clear elaboration of the selected matter with regards to case law findings of the European Court of Human Rights and the Supreme Court of the Czech Republic. I also point out conclusions that I consider problematic, and I propose more appropriate solutions. This concerns e.g. differentiating between judgment of the existence of a flawed clerical procedure and determination of reasonable satisfaction (chapter two), as well as methods for determining reasonable satisfaction (chapter four).
