Abstract |

Nařízení Řím I v článku 8 odst. 1 umožňuje zvolit právo rozhodné pro individuální pracovní smlouvy. Nicméně, autonomie vůle stran je v tomto ustanovení zásadně omezena, volba práva nesmí zaměstnance zbavit ochrany, jež mu poskytují kogentní ustanovení práva, které by se aplikovalo v případě neexistence volby práva. Příspěvek se zabývá opodstatněností volby práva u individuálních pracovních smluv. Cílem příspěvku je zhodnotit, zdali je uvedená flexibilita vhodná, nebo by měla převážit aplikace hraničního určovatele práva země, kde zaměstnanec obvykle vykonává svoji práci, resp. práva země, v níž se nachází provozovna, která zaměstnance přijala do zaměstnání, příp. práva země, s níž je individuální pracovní smlouva úžeji spojena. |

Article 8(1) of the Rome I Regulation permits the choice of law for individual contracts of employment. Nevertheless, autonomy of the parties is fundamentally limited in this provision. In accordance with Article 8(1) such a choice of law may not have the result of depriving the employee of the protection afforded to him by provisions that cannot be derogated from by agreement under the law that, in the absence of choice, would have been applicable. Contribution deals with the legitimacy of the choice of law for individual contracts of employment. The aim of this contribution is to evaluate whether stated flexibility is appro-priate or should prevail application of connecting factor of the law of the country in which the employee habitually carries out his work respectively the law of the country where the place of business through which the employee was engaged is situated eventually the law of the country with which the individual employment contract is more closely connected. |
