Abstract

Ač je to v České republice spíše výjimečné, jinde se na vrcholné soudy obrací pouze advokáti, kteří se na daný typ řízení úzce specializují a kteří případy, se souhlasem klientů, přebírají od svých méně zkušených kolegů. Měla by tato praxe své opodstatnění i v kontextu řízení před Ústavním soudem? Mají zkušenější advokáti v řízení před Ústavním soudem větší šance na úspěch? Autoři na tyto otázky odpovídají kladně, a to na základě analýzy dat o 40 489 konečných rozhodnutích Ústavního soudu, k nimž byli schopni přiřadit konkrétního advokáta. Přispívají tak k širší teoreticko-vědní diskusi o vztahu mezi zkušeností advokáta a jeho šancemi na úspěch v řízení před soudem. Nad rámec testování existujících hypotéz autoři dále zpřístupňují dosud nikde neuveřejněné statistiky o vystupování advokátů před Ústavním soudem.

Abstract (in English)

In the Czech Republic, it is rather uncommon that apex courts are applied to only by lawyers who specialize in the relevant type of procedure and who take over, with the consent of a client, the case from their less experienced colleagues. However, it is a standard elsewhere. Would such a practice be justifiable also in the context of proceedings before the Constitutional Court of the Czech Republic? Are the experienced lawyers more likely to win before the Court? Authors answer this question in the affirmative. They do so on the basis of the analysis of data on 40,489 final rulings of the Court to which they were able to assign a concrete lawyer. Thus, they contribute to broader scientific debate regarding the relation between a lawyer’s experience and her chances of success in a court. Beyond testing existing hypotheses, the authors also make public some statistics on the behavior of lawyers before the Court that have never been published before.
