Abstract
In 2015, the UN Climate Change Conference in Paris together with the adoption of the United Nations 2030 Agenda on Sustainable Development launched the new era of a global transition to a low-carbon economy. Although the EU presents itself being at the forefront of this global effort, various reports indicate that European investments in energy efficiency and renewable energy are not consistent with the goal of limiting global rise in temperature to less than 2°C set by the Paris Agreement. Significant deployment of additional private investments is required. However, a special character of energy investments needs predictable and stable regulatory framework and remedies against host states for a breach of rule of law. Investment law provides investors with both substantive guarantees and investors-state dispute resolution mechanism. This paper analyses investment protection of energy projects in the EU. Special attention is given to applicable instruments of international law at disposal of European investors.
