Abstract

This paper seeks to analyze the impact of the Ukrainian crisis on the investment protection of energy projects in Crimea. Special attention is given to the status of Crimean Peninsula for the purposes of application of bilateral or regional investment treaties. The paper reflects rising number of investment arbitrations initiated by Ukrainian investors against Russian Federation registered under the Permanent Court of Arbitration in the Hague.

Tento příspěvek analyzuje vliv krize na Ukrajině, zejména otázku mezinárodněprávního statusu území polostrova Krym, na možnou investiční ochranu energetických projektů. Příspěvek se věnuje jednotlivým pramenům investiční ochrany a limitům jejich aplikace. Autor reaguje na vzrůstající množství investičních arbitráží iniciovaných ukrajinskými investory proti Ruské federaci (např. Aeroport Belbek LLC and Mr Kolomoisky v The Russian Federation) registrovaných u Permnament Court of Arbitration.
