Abstract (in Czech)
Příspěvek vymezuje a analyzuje principy relevantní při ukládání správních trestů. Jedná se tak o téma navýsost aktuální již jen s ohledem na účinnost nové právní úpravy přestupků v České republice a zvažovanou rekodifikaci ve Slovenské republice. V příspěvku bude tudíž poukázáno na tyto principy a specifikován jejich obsah, zhodnocen jejich význam a projev v platné právní úpravě. Taktéž bude zmíněn jejich projev při projednání správních deliktů (přestupků) správními orgány, případně přezkumu jejich rozhodnutí správními soudy.

Abstract (in Czech)

Příspěvek vymezuje a analyzuje principy relevantní při ukládání správních trestů. Jedná se tak o téma navýsost aktuální již jen s ohledem na účinnost nové právní úpravy přestupků v České republice a zvažovanou rekodifikaci ve Slovenské republice. V příspěvku bude tudíž poukázáno na tyto principy a specifikován jejich obsah, zhodnocen jejich význam a projev v platné právní úpravě. Taktéž bude zmíněn jejich projev při projednání správních deliktů (přestupků) správními orgány, případně přezkumu jejich rozhodnutí správními soudy.

Abstract (in English)
The paper defines and analyses the principles which are relevant to imposing administrative penalties. It is an issue which is very actual and important because of the effectiveness of new regulations of offences in the Czech Republic and the considered recodification in the Slovak Republic. The paper also enumerates these principles and specifies their content, evaluates their importance and expression in the valid legal regulation. Moreover, it mentions their expression in administrative criminal proceedings by administrative bodies, eventually in reviewing the decisions by administrative courts Special attention is given to constitutional principles.
