Abstract

Úvahová recenze se zabývá dvěma posledními monografiemi profesora Pavla Holländera Příběhy právních pojmů (2017) a Pojmy v Sizyfovej krošni (2015). Přibližuje hlavní myšlenky obou prací, přičemž si všímá jednak otázek ontologických, kde Holländer hájí principiální odlišení pozitivistického a přirozenoprávního pohledu na právo a jednak otázek noetických, kde autor recenzovaných textů akceptuje nonkognitivistický postoj. V recenzi je proto na závěr tematizována otázka slučitelnosti těchto postojů a naznačeno, zda by řešení nemohlo spočívat v kritickém zhodnocení nonkognitivistického východiska a v důsledku toho v obrácení perspektivy, tedy postavit myšlení zpět na nohy kognitivistického realismu, za současné akceptace praktické omezenosti naší schopnosti poznávat.

Abstract (in English)

The reflective review deals with the two most recent monographs by Professor Pavel Holländer, Příběhy právních pojmů (Stories of Legal Concepts, 2017) and Pojmy v Sizyfovej krošni (Concepts - In Sizyf's Crown, 2015). It describes the main ideas of both pieces of work, paying attention both to ontological questions, where Holländer defends the fundamental distinguishing of the positivist approach to the law and the natural-law one, and to noetic questions where the author of the texts reviewed accepts the non-cognitivist attitude. That’s why the review concludes by the issue of compatibility of these attitudes, and suggests that a solution could consist in a critical evaluation of the non-cognitivist starting point and, as a consequence, in reversing the perspective, it means in returning to cognitivist realism in thinking, accepting the practical limitedness of our cognitive ability at the same time.
