Abstract

Po roce 1989 byla zvlášť pozorně a citlivě sledována transformace zpravodajských služeb. Tato je příkladem diskontinuity právní úpravy specifického oboru (oblasti), v níž došlo k zásadní proměně, kterou lze charakterizovat jako cestu od neregulace k regulaci, a v níž byl v historicky krátké době učiněn pokus o aplikaci základních principů právního státu. Příspěvek je věnován transformačnímu období, v jehož průběhu byla přijata historicky první zákonná úprava postavení a činnosti zpravodajských služeb u nás, a které bylo ukončeno v roce 1994 schválením relativně komplexní právní úpravy, která zakotvila systém postavení a činnosti zpravodajských služeb České republiky, který je v zásadě platný dosud.

Abstract (in English)

Transformation of the intelligence services was particularly closely and sensitively monitored after 1989. This is an example of discontinuity legislation specific field (s) in which there has been a fundamental change, which can be characterized as a way of non-regulation to regulation, and in which he was in a historically short period attempted application of the fundamental principles of the rule of law. The paper is devoted to the transition period, during which was adopted first ever statutory regulation of the status and activities of the intelligence services in our country, which was completed in 1994, the approval of a relatively complex legislation that enshrines the system status and activities of the intelligence services of the Czech Republic, which is in basically still valid.
