Abstract

První nařízené setkání se zapsaným mediátorem je jedním z právních nástrojů působení soudu na strany za účelem smírného vyřešení sporu. Institut byl zaveden do českého právního řádu v roce 2012. V první části příspěvku je pojednáno o genezi a podstatě prvního nařízeného setkání se zapsa- ným mediátorem. Další část příspěvku se věnuje fungování zkoumaného institutu v praxi. Poslední část je pak zaměřena na to, zda institut prvního setkání se zapsaným mediátorem obstojí v kontextu zásad civilního procesu. Práce dospívá k závěru že, zkoumaný institut v poměřování se zásadami civilního procesu obstojí, byť lze do budoucna uvažovat o dílčích úpravách cílících zejména na zlepšení ve vztahu k hospodárnosti řízení.

Abstract (in English)

The first meeting with a registred mediator is one of the legal tools of the court’s action on the parties to settle the dispute amicably. The institute was introduced into the Czech legal system in 2012. The first part of the paper deals with the genesis and essence of the first ordered meeting with a regis- tered mediator. The next part of the paper deals with the functioning of the researched institute in practice. The last part is focused on whether the insti- tute of the first meeting with the registered mediator will stand in the context of the principles of the civil process. The thesis concludes that the investi- gated institute will stand up in the context of the principles of civil process, although partial adjustments aiming in particular at improvement in relation to the economy of civil proceedings can be considered in the future.
