Abstract

Autor ve své práci reaguje na výklad pojmu retroaktivity v rozhodnutí Nejvyššího soudu České republiky ze dne 28. 7. 2010, sp. zn. 8 Tdo 797/2010, publikovaném pod č. 53/2011 Sb. rozh. tr., které podle jeho názoru vybízí k důkladnějšímu studiu tohoto jevu. Vychází zde z postulátů normativní právní školy, dále popisuje základní vztahy mezi právem a časem, jakož i – stručně - chápání času v reálném světě v minulosti i nyní, kdy se blíže zabývá tzv. rovinami časovosti, pojmu zavedeného v šedesátých letech minulého století zakladatelem vědního oboru časovědy a Mezinárodní společnosti pro studium času J. T. Fraserem. Rozlišuje zde mezi těmi rovinami, jež jsou ovládány tzv. šipkou času a mezi těmi, jež jsou typické pro duševní pochody člověka, včetně procesu interpretace a aplikace práva. Takto zjištěné poznatky pak autor konfrontuje s oním rozhodnutím Nejvyššího soudu.

Abstract (in English)

In his thesis, the author responds to the interpretation of the concept of retroactivity in the decision of the Supreme Court of the Czech Republic, Case No. 8 Tdo 797/2010 of 28th July 2010, published under No. 53/2011 Colllection of Decisions and Opinions of the Supreme Court. This decision calls for a more thorough study of this phenomenon. The author’s opinion is based on the postulates of the normative law school, he also describes the basic relations between law and time as well as - briefly - the understanding Sekce: Aktuální problémy právní teorie 343 of the time in the real world in history and nowadays, especially by the socalled Levels of Temporality, the concept having introduced by J. T. Fraser, a founder of Chronosophy as a discipline as well as the International Society for the Study of Time in the 1960’s. The author distinguishes levels controlled so-called time arrow and those that are typical of man’s mental processes, including the process of interpretation and application of the law. In this way, the author confronts the decision of the Supreme Court.
