The aim of this article is to analyse the law applicable to international licence contracts with international element under the Rome I Regulation. The focus is on the analysis of Article 4 Rome I Regulation, especially section (2) based on the ‘characteristic performance’ criterion. The theoretical analysis is then applied to different types of international licence contracts.
