Abstract

Příspěvek komentuje aktuální situaci praxe identifikování koncových zařízení webovými stránkami v kyberprostoru. Nejprve je podána přehledná analýza současného stavu, založená na komparaci výsledků jednotlivých zkoumání různých výzkumných týmů a jsou popsány nejčastější nekalé praktiky identifikace online. To je pak postaveno do kontrastu s aktivitou českého Úřadu pro ochranu osobních údajů a jeho sankcionováním. Autor následně upozorňuje na postupný přechod od převládajícího způsobu identifikace pomocí http cookies k jiným pokročilejším metodám, včetně web beacons, fingerprintingu či metod ukládajících identifikátory na různá místa v koncových zařízeních jako je např. local storage apod. Svá tvrzení dokazuje na vlastním průzkumu nejnavštěvovanějších česky píšících webových stánek, ve kterém se zaměřil právě na plnění právních povinností webovými stránkami při používání pokročilých metod identifikace. V článku tedy přestavuje jak závěry vlastního kvantitativního průzkumu, tak i důsledky vysledovaných jevů.

Abstract (in English)

The paper comments on the current situation of the practice of terminal equipment identification by websites in cyberspace. At first, author presents a clear analysis of the current situation, based on a comparison of the results of several investigations of various international research teams. It describes the most common unfair practices of online identification. This is in contrast to the activity of the Czech Office for Personal Data Protection and its sanctioning. The author then points out to the gradual transition from the predominant method of identification by using http cookies to other more advanced methods, including web beacons, fingerprinting or methods storing identifiers in various places in terminal equipment such as local storage, etc. In his claims, the author draws on his own survey of the most frequently visited Czech web pages. The quantitative research is focused precisely on the fulfillment of legal obligations by web pages using advanced identification methods. Thus, the article presents both the conclusions of the quantitative survey itself and the consequences of the observed phenomena.
