Abstract

V současné době se můžeme na internetových stránkách českých reprodukčních klinik běžně setkat s nabídkou poskytování nejen standardních služeb v oblasti asistované reprodukce, ale také stále rozšiřujícího se fenoménu náhradního či surogátního mateřství. Stejně tak existuje vetší množství internetových diskuzí či jiných platforem, na kterých dochází ke sdílení soukromých zkušeností s využitím náhradních matek, tedy žen, jejichž úloha spočívá ve sjednaném početí, odnošení a vzdání se dítěte ve prospěch neplodného páru. Vyvstává však otázka, zda a za jakých podmínek je využívání náhradních matek v souladu se zákonem.

Abstract (in English)

At present, we can usually find on the websites of Czech reproductive clinics the offer of providing not only standard services in the field of assisted reproduction, but also the ever-expanding phenomenon of surrogacy. There are also a number of online discussions or other platforms that share private experiences with the use of surrogate mothers, that means women, whose role based on conceiving, taking away and giving up a child in favor of an infertile couple. However, the question arises as to whether and under what conditions the use of surrogate mothers is in accordance with the law.
