Abstract

Východní Asie, Evropa a následně celý svět byl v prvním kvartálu roku 2020 svědkem šíření a s tím související pandemie nového, lidstvu dosud neznámého typu viru, který dostal název koronavirus SARS-CoV-2. V souvislosti s šířením koronaviru a s tím související hysterií, strachem z neznámého a stále se zpřísňujících restriktivních opatření vlád jednotlivých států nabrala pandemie mimo jiné i rozměr trestněprávní. Vyvstává tak otázka, jakým způsobem by měly orgány činné v trestním řízení na trestné činy související s koronavirem nahlížet, jakým způsobem by se k nim mělo přistupovat, jak by se měly hodnotit. Vyvstává též otázka, zda by na takové trestné činy měla reagovat kriminalistická taktika, a pokud ano, zda již od samého počátku, tj. od okamžiku plánování a organizace vyšetřování, popř. zda by příslušné reakce měly nastoupit až v průběhu či na konci vyšetřování, anebo zda kriminalistická taktika na šíření koronaviru reagovat nemusí.

Abstract (in English)

East Asia, Europe and then the whole world has been in the first quarter of 2020 witness of the spreading and associated pandemic of a new, yet unknown type of virus, which has been named coronavirus SARS-CoV-2. In connection with the spread of coronavirus and the associated hysteria, fear of unknown and ever tightening restrictive measures by national governments has the pandemic also taken on a criminal dimension. This raises the question of how law enforcement authorities should treat coronavirus-related crimes and how should be assessed. There is as well the question, whether there should be any reaction on these crimes by tactics of criminalistics and if, whether from the very beginning, i. e. from the moment of planning and organization of the investigation, or whether the relevant reactions should start during or at the end of the investigation, or whether the tactics of criminalistics may not respond to the spread of coronavirus.
