Abstract

Der Gastvortrag am Juridicum der Universität Wien analysierte die Rechtsbeziehung der Staatsbürgerschaft und des Heimatrechts in der österreichischen Monarchie und den Nachfolgerstaaten: der Ersten Österreichischen Republik und der Ersten Tschechoslowakischen Republik. Diese zwei zusammenhängenden Phänomene hatten die schützende und identifizierende Funktion des Inhabers. Ohne das Heimatrecht konnte die Staatsbürgerschaft nicht erworben werden. Im Zentrum des Gastvortrags standen problematische Rechtsfälle des Erwerbs der Staatsbürgerschaft in den Nachfolgerstaaten nach dem Zerfall der österreichischen Monarchie.

Abstract (in Czech)

Zvaná přednáška na právnické fakultě ve Vídni analyzovala právní vztah občanství a domovského práva v rakouské monarchii a nástupnických státech: I. Rakouské republice a I. Československé republice. Tyto dva související fenomény měly funkci chránit nositele a identifikovat jej. Bez udělení domovského práva nemohlo být získáno státní občanství. Přednášející se zabývala problematickými právními situacemi získání státního občanství v nástupnických státech po rozpadu Habsburské monarchie.

Abstract (in English)

The guest lecture at the law faculty in Vienna analysed the legal relationship between citizenship and the right of domicile in the Austrian monarchy and its successor states: The First Austrian Republic and the First Czechoslovak Republic. These two interrelated phenomena served to protect individuals and identify them. State citizenship could not be acquired without being granted the right of domicile. The lecturer examined the problematic legal situation regarding the acquisition of state citizenship in the successor states following the break-up of the Habsburg monarchy.
