Abstract

Critical assessment of attempts to extend the scope of antitrust to areas which do not relate to the protection of competition as a result of market failure. Recommendation to vigorously resist them. Competition law has to actively face new challenges, particularly technological ones, that traditional approaches cannot deal with effectively. However, it must always be about protecting competition and consumer welfare, not about foisting a political agenda on the antitrust authorities under the guise of significant social change.

Abstract (in Czech)

Kritika pokusů o rozšíření působnosti antimonopolního práva do oblastí nesouvisejících s ochranou hospodářské soutěže v důsledku selhání trhu. Doporučení důrazně se takovým pokusům bránit. Soutěžní právo musí aktivně čelit novým výzvám, zejména technologickým, s nimiž se tradiční přístupy nemohou účinně vypořádat. Vždy však musí jít o ochranu hospodářské soutěže a blahobytu spotřebitelů, nikoli o vnucování politické agendy antimonopolním orgánům pod záminkou významných společenských změn.
