Abstract

Opatření, jejichž cílem byla minimalizace rizika šíření nákazy onemocněním SARS-COV-2, zasáhla trestní právo v celé jeho šíři, a to včetně tzv. vykonávacího řízení. Z tohoto důvodu bude příspěvek pojednávat o problematice omezených možností nápravy odsouzeného v době probíhající pandemie. V příspěvku budou přiblíženy různé nástrahy a různá úskalí, jimž čelili a na něž naráželi jak odsouzení, tak zaměstnanci Probační a mediační služby ČR či příslušníci Vězeňské služby ČR při realizaci programů zacházení a dalších programů, jež mají napomáhat snazší resocializaci a rehabilitaci vězňů v rámci výkonu trestu odnětí svobody a po jejich propuštění. Nejdříve budou představena obecná východiska problematiky programů zacházení. Dále bude pozornost věnována konkrétním omezením při realizaci rozličných aktivit, jež jsou součástí příslušných programů, a to s akcentem na problematiku zaměstnávání odsouzených, jejich vzdělávání nebo uskutečňování zájmových aktivit během trvání a platnosti různých mimořádných opatření.

Abstract (in English)

The measures aimed at minimizing the risk of spreading SARS-COV-2 disease affected the criminal law in its entirety, including the so-called enforcement procedure. For this reason, this paper will deal with the issue of limited possibilities of correction of a convicted persons during the ongoing SARS-COV-2 pandemic. This paper will describe the various pitfalls encountered by both convicted persons and employees of the Probation and Mediation Service of the Czech Republic or members of the Prison Service of the Czech Republic in the implementation of treatment programs and other programs that are intended to facilitate the resocialization and rehabilitation of prisoners and that are also aimed at preventing their recidivism after release from prison. First, the general starting points of the issue of treatment programs implemented in Czech prisons for prisoners will be presented. Subsequently, attention will be paid to the issue of specific restrictions in the implementation of various activities that are part of the relevant treatment programs, with an emphasis on the issue of employment of convicted persons during the so-called lockdown, education of convicted persons or im-plementation of leisure activities of convicted persons during the validity of various emergency measures.
