Abstract

Z praktického hlediska jsou lidská práva velmi úspěšný koncept. Stojí v centru diskuzí právníků, politiků i novinářů. V oblasti teorie však zůstávají zdrojem pochybností. Vyvolává je zejména otázka, jakými důvody jsou ospravedlněna. Odpověď na ni hledá tato kniha v jejich propojení s utilitaristickou etikou. Jakkoliv bývá toto spojení někdy vnímáno jako kontroverzní, usiloval o něj již John Stuart Mill a dodnes je předmětem živých debat. Ty jsou v knize zasazeny do širšího rámce lidskoprávní teorie a s ní spojených problémů. Kniha tak čtenáře seznamuje nejen se samotným utilitarismem a různými způsoby, jak může být aplikován v této oblasti, ale poskytuje mu i reprezentativní přehled a kritický rozbor v současnosti nejvíce diskutovaných přístupů k justifikaci lidských práv.

Abstract (in English)

In practical terms, human rights is a very successful concept. They are at the centre of discussions among lawyers, politicians and journalists. In the realm of theory, however, they remain a source of doubt. In particular, the question of what grounds justify them. This book seeks to answer this question by linking them to utilitarian ethics. Controversial as this connection is sometimes perceived to be, it was already sought by John Stuart Mill and is still the subject of lively debate today. These are set in the book within the broader framework of human rights theory and its associated problems. The book thus not only introduces the reader to utilitarianism itself and the various ways in which it can be applied in this field, but also provides a representative overview and critical analysis of the most debated approaches to human rights justification today.
