Abstract

Úředním osobám je při výkonu jejich pravomocí svěřeno mj. oprávnění užívat výzvy, které jsou pro jejich adresáty závazné. V případě jejího oslyšení může být nevyhovění dané výzvě kvalifikováno jako přestupek neuposlechnutí výzvy úřední osoby. Tento příspěvek se zaměří na charakteristiku výzev úředních osob, jejich právní úpravu, odpovědnostní aspekty neuposlechnutí výzvy úřední osoby, jakož i možné způsoby obrany proti výzvám vydaným v rozporu s platnou právní úpravou.

Abstract (in English)

Persons in authority are allowed to issue a command, which is binding for the addressee. In the case of failure to comply with the command, it may be qualified as an offense of disobeying the command of an official. This conference paper will focus on the characteristics of commands of official persons, their legal regulation, the liability aspects of disobeying these commands, as well as possible ways of defending against commands issued in violation of the applicable legislation.
