Abstract

Příspěvkem připomínám prvorepublikového nejslavnějšího právního sociologa Emanuela Chalupného. Ukazuje, že mnohé jeho myšlenky byly na svou dobu novátorské, ať již se jednalo o vztah práva a morálky, kdy Chalupný uvádí, že většina jevů v právu je amorálních, či jeho kritiku trestu smrti s požadavkem reformy trestního práva. Autorka připomíná i jeho názory státovědní. Chalupný vidí pro stát prioritní území a jeho geografický reliéf. Podrobně se zabývá i povahou československého národa, který dělí do typu českého, moravského a slovenského. Češi stejně jako Slováci jsou horalé, moravská povaha se pak vyznačuje sociální přizpůsobivostí. Na závěr textu je pak připomenut význam sociologie práva pro právníky a nutnost se této disciplíně věnovat v rámci studia.

Abstract (in English)

With this post, I am commemorating the First Republic's most famous legal sociologist, Emanuel Chalupný. It shows that many of his ideas were innovative for their time, whether it was the relationship between law and morality, when Chalupný states that most phenomena in law are amoral, or his criticism of the death penalty with the demand for criminal law reform. The author reminds us of his political views. Chalupný sees the territory and its geographical relief as a priority for the state. He also deals in detail with the nature of the Czechoslovak nation, which he divides into the Czech, Moravian and Slovak types. Czechs, like Slovaks, are highlanders, and the Moravian character is characterized by social adaptability. At the end of the text, the importance of the sociology of law for lawyers and the necessity to devote themselves to this discipline as part of their studies is recalled.
