Ideological analyses of various societal issues is a rather old discipline at last formalized by the society of ideologist as soon as the 18th century. Since than, Ideological analysis keeps haunting us and returns with its tools and objects altered for the given age. Within the age we find ourselves now the analyses should emphasis mainly ”the new” - the digital and the automated. Where else should it be more pressing than where state uses its most coercive power to regulate the behaviour of its citizens - in the judicial setting, that has been penetrated by technologies in the interest of efficency and effectivness over due process and human agency. Due to the nature of such systems however, this (mis)percieved technological rapture is a mere return of the old. The ever present surveillance capitalism and the prevalence of Big Data, that could feed the decision making algorithms are thus breaking down the walls of courthouses and the Power vested in the judiciary penetrates our everyday life. Even the fact that it most likely is not the situation, with its mere could, helps bring about a new technology of power, finally moving the governmentality from biopolitics, to the new age of psychopolitics.
