Abstract

Publikace „Bagatelizace a násilí“ je sociálně-vědná reflexe genderovaného a sexuálního násilí a reprodukce genderových stereotypů v textech soudních rozsudků. Jde o kvalitativní analýzu 72 textů rozsudků z let 2019–20 v případech znásilnění a domácího násilí. Analyzován byl soubor anonymizovaných rozsudků, které poskytla organizace proFem. Analýza se zaměřila na to, jak jsou v rozsudcích vykreslováni pachatelé a oběti trestných činů, jak jsou odůvodňovány tresty a jak soud zachází s výpověďmi jednotlivých aktérů nebo jakou váhu dává znaleckým posudkům. Na těchto podkladech analýza poodkrývá praxi soudů a naznačuje, kdy a jak český soudní systém spíše reprodukuje genderové stereotypy a kdy je překonává. Text zachycuje, jak se celospolečenské nastavení promítá do soudní praxe.

Abstract (in English)

The publication „Downplaying and Inequalities“ presents a social-scientific reflection of gendered and sexual violences and the reproduction of gender stereotypes in the texts of court judgments. It is a qualitative analysis of 72 judgment texts from 2019-20 in cases of rape and domestic violence. A set of anonymized judgments provided by the proFem organization was analysed. The analysis focused on how perpetrators and victims of crimes are portrayed in the judgments, how punishments are justified and how the court treats the statements of individual actors or what weight it gives to expert opinions. Based on these sources, the analysis highlights the practice of the courts and indicates when and how the Czech judicial system tends to reproduce gender stereotypes and when it overcomes them. The text captures how the societal setting is reflected in court practice.
