Abstract

Problematika nelegální výroby a obchodu s drogami představuje pro moderní společnost jednu z výzev, která úzce souvisí s udržitelným rozvojem lidstva. Z tohoto hlediska by bylo dosažení cílů udržitelného rozvoje, jako je dobré zdraví a blahobyt (3), udržitelná města a komunity (11) a mír, spravedlnost a silné instituce (16), mnohem obtížnější, pokud by otázka kriminality související s drogami nebyla náležitě vzata v potaz. Cílem tohoto příspěvku je poukázat na některé problémy spojené s tímto typem kriminality z pohledu České republiky a nabídnout in eventum obecná doporučení pro účinnou prevenci a ochranu jednotlivců i komunit před tímto typem protiprávního jednání. Nejprve bude diskutován přeshraniční kontext nelegální výroby metamfetaminu a jeho dopady na životní prostředí v městských i venkovských oblastech. Zadruhé bude představena problematika nových syntetických drog, jejich uznávání jako omamných a psychotropních látek podle příslušných Úmluv OSN a s tím spjaté hledání účinné ochrany jednotlivců i komunit se zaměřením na přístup české legislativy a praxe orgánů činných v trestním řízení. V rámci tohoto tématu bude diskutována problematika právem neregulovaného semisyntetického kanabinoidu HHC.

Abstract (in Czech)

The issue of illegal drug production and drug trafficking represents one of the challenges for modern society, that is closely connected with sustainable development of mankind. In this point of view achieving sustainable development goals such as good health and well-being (3), sustainable cities and communities (11) and peace, justice and strong institutions (16) would be much more difficult if the question of drugs related crime would be neglected. The aim of this paper is to point out some issues connected with this type of criminality from the Czech Republic perspective and to provide some general recommendations on effective prevention and protection of individuals as well as communities from such type of illegal behavior. First, the cross-border context of illegal production of methamphetamine and its impacts on environment in both urban and rural areas will be discussed. Second, the problem of new synthetic drugs, their recognition as narcotics and psychotropic substances under relevant United Nations Conventions and thus searching for effective protection of both individuals and communities will be presented with focus on approach of Czech legislation and law enforcement authorities practice. Within this topic, the issue of non-restricted type of semisynthetic cannabinoid HHC will be discussed.
