Abstract

Konferenční příspěvek v rámci sekce Osobnosti středoevropské civilistiky pojednal o osobnosti Franze Xavera Hofmanna, který na poli právních dějin a římského práva během poměrně krátké doby přispěl důležitými zjištěními (např. španělský původ fideikommisu či stejný ideový základ beneficia inventarii a separatia bonorum), a který podrobil kritice Bluhmeho teorii masy, to vše za pomocí historicky kritické, dogmatické a exegetické metody výzkumné práce.

Abstract (in English)

The conference paper in the section of Personalities of Central European Civil Law discusses the personality of Franz Xaver Hofmann who contributed important findings in the field of legal history and Roman law in a relatively short period of time (e.g. the Spanish origin of the fideicommissus or the same ideological basis of beneficia inventarii and separatio bonorum), and who criticized Bluhm’sche Massentheorie, all with the help of a historically critical, dogmatic and exegetical method of research.
