Abstract

Das Buch befasst sich mit der Problematik der Abtreibung, wobei ihre menschenrechtlichen Aspekte und ihr Bezug zur Dienstleistungsfreiheit innerhalb der Europäischen Union im Vordergrund stehen. Mit anderen Worten werden zwei Dimensionen der Abtreibung erforscht. Die erste Dimension hängt mit dem immer noch umstrittenen Konzept der Abtreibung als ein Menschenrecht zusammen, einschließlich der Art und des Umfangs ihres institutionellen Schutzes. Die zweite Dimension ist unterschiedlicher Natur, da sie die Abtreibung nicht als ein Menschenrecht, sondern als eine Gesundheitsdienstleistung im Sinne des EU-Primärrechts betrachtet, und zwar in Bezug auf eine der Grundfreiheiten des freien Verkehrs. In methodischer Hinsicht wird nicht nur auf die Analyse des internationalen Rechtsrahmens für die Abtreibung und der damit verbundenen Rechtsprechung des EGMR und des EUGH, sondern auch auf den Vergleich der nationalen Abtreibungsrechtsvorschriften zurückgegriffen. In diesem Kontext wird auch das Phänomen des Abtreibungstourismus in Betracht gezogen, das aufgrund der Garantie des freien Dienstleistungsverkehrs innerhalb der Europäischen Union schwer zu verhindern ist.

Abstract (in Czech)

Kniha se zabývá problematikou interrupcí se zaměřením na jejich lidskoprávní aspekty a jejich vztah ke svobodě poskytování služeb v Evropské unii. Jinými slovy, jsou zkoumány dva rozměry interrupcí. První rozměr souvisí se stále sporným pojetím interrupce jako lidského práva, včetně povahy a rozsahu jeho institucionální ochrany. Druhý rozměr má odlišnou povahu, neboť interrupce nepovažuje za lidské právo, ale za zdravotní službu ve smyslu primárního práva EU, a to ve vztahu k jedné ze základních svobod volného pohybu. Z metodologického hlediska kniha nejen analyzuje mezinárodní právní rámec a související judikaturu Evropského soudu pro lidská práva a Soudního dvora Evropské unie, ale také porovnává národní právní předpisy týkající se interrupcí. V této souvislosti se kniha zabývá také fenoménem potratové turistiky, kterému je obtížné zabránit vzhledem k zaručení volného pohybu služeb v rámci Evropské unie.

Abstract (in English)

The book deals with the issue of abortion, focussing on its human rights aspects and its relation to the freedom to provide services within the European Union. In other words, two dimensions of abortion are explored. The first dimension is related to the still contested concept of abortion as a human right, including the nature and extent of its institutional protection. The second dimension is of a different nature, as it considers abortion not as a human right but as a health service in the sense of EU primary law, in relation to one of the fundamental freedoms of movement. From a methodological point of view, the study not only analyses the international legal framework for abortion and the related case law of the ECtHR and the CJEU, but also compares national abortion legislation. In this context, the phenomenon of abortion tourism, which is difficult to prevent due to the guarantee of the free movement of services within the European Union, is also considered.
