Abstract

Tento článek shrnuje základní závěry judikatury správních soudů a zejména Nejvyššího správního soudu k neurčitému právnímu pojmu charakter území, tradičně a často využívanému předpisy veřejného stavebního práva. Definice tohoto pojmu v českém právním řádu až donedávna absentovala, takže bylo nutné vycházet výhradně z judikatury, které se se však odborná literatura příliš důsledně nevěnuje.

Abstract (in English)

This article summarizes the basic conclusions of the case law of the administrative courts and in particular the Supreme Administrative Court on the vague legal concept of the character of the territory, traditionally and frequently used in public construction law regulations. The definition of this concept was absent in the Czech legal order until recently, so it was necessary to rely exclusively on on case law, which, however, is not consistently dealt with in the specialist literature.
