Abstract

Korespondenční hlasování je tradiční alternativa k osobnímu hlasování ve volební místnosti. Zvyšuje však komplexnost volebního procesu, což s sebou může nést určité problémy. V této explorativní studii skrze zmapování judikatury ústavních soudů identifikuji, o jaké problémy se jedná a jak tyto problémy ústavní soudy řeší. Po představení problémů, které již zachytila dosavadní literatura, vymezuji metodologii studie. Jedná se o explorativní studii, jejíž podstata spočívá v uceleném a systematickém zmapování soudních rozhodnutí vybraných na základě předem určených kritérií. V další části pak představuji problémy korespondenčního hlasování, kterými se zabývaly ústavní soudy, a způsoby jejich řešení, identifikované ve vzorku 37 rozhodnutí 11 ústavních soudů. V závěrečné části shrnuji výsledky studie.

Abstract (in English)

Postal voting is the traditional alternative to personal voting at the polling station. However, it increases the complexity of the electoral process, which can cause problems. In this explorative study, by mapping the case law of the constitutional courts, I identify what these problems are and how the constitutional courts address them. After introducing the problems already mentioned in the existing literature, I define the methodology of the study. This is an explorative study, the essence of which consists of a comprehensive and systematic mapping of decisions selected on predetermined criteria. In the next section, I present the problems of postal voting that have been addressed by the constitutional courts and the ways of solving them, identified in a sample of 37 decisions of 11 constitutional courts. In the final section, I summarize the results of the study.
