Abstract

Kapitola se zabývá vývojem pojetí obecné část finančního práva. Finanční právo svým charakterem patří mezi inkorporovaná odvětví práva a nalezení jeho obecné části je výsledkem především vědy finančního práva a aplikační praxe. Nalezení obecné části finančního práva souvisí s akceptací jeho samostatnosti právní vědou. Bylo nutné zabývat se obecným vymezením finančního práva, pojetím obecné části finančního práva v období III. Československé republiky, lety 1948 – 1990, koncem éry socialistického finančního práva a konečně vymezením obecné části finančního práva v demokratickém právním státě.

Abstract (in English)

The chapter deals with the development of the concept of the general part of financial law. Financial law, by its nature, belongs to the incorporated branches of law, and finding its general part is primarily the result of the science of financial law and application practice. Finding the general part of financial law is related to the acceptance of its independence by jurisprudence. It was necessary to deal with the general definition of financial law, the concept of the general part of financial law in period III. The Czechoslovak Republic, years 1948 – 1990, the end of the era of socialist financial law and finally the definition of the general part of financial law in a democratic legal state.
