Abstract

Kapitola je věnována vztahu mezi autorským právem a užíváním autorskoprávně chráněného obsahu na Internetu. Kapitola podrobně rozebírá, jakými způsoby autorský zákon reguluje užití autorských děl v online prostředí. Dále se zaměřuje na to, jak technologie a Internet ovlivňují distribuci a přístup k autorským dílům. Autor představuje zásadní mezinárodní smlouvy, které byly uzavřeny za účelem adaptace autorského práva na digitální éru a internetové prostředí, a analyzuje důsledky těchto smluv pro autorské právo na národní úrovni. Zmíněny jsou i specifické autorskoprávní instituty, jako je sdělování díla veřejnosti, rozmnožování díla, hyperlinkování, a problematika odpovědnosti online platforem, které jsou klíčové pro pochopení právní regulace autorského práva v kontextu Internetu (včetně nové právní úpravy, kterou přináší DMA a DSA).

Abstract (in English)

The chapter is dedicated to the relationship between copyright law and the use of copyrighted content on the Internet. It thoroughly discusses the ways in which copyright law regulates the use of works in the online environment. Furthermore, it focuses on how technology and the Internet affect the distribution and access to copyrighted works. The author introduces key international treaties that have been concluded to adapt copyright law to the digital era and the online environment, and analyzes the consequences of these treaties for copyright law at the national level. Specific copyright institutions, such as the communication of works to the public, reproduction of works, hyperlinking, and the issue of online platforms' liability, which are crucial for understanding the legal regulation of copyright law in the context of the Internet (including the new legal regulations brought by the DMA and DSA), are also mentioned.
