Abstract

Jendím z novelizovaných zákonů v rámci konsolidačního balíček byl i zákon o vysokých školách ve vztahu k fondu sociálnímu. Autor se zaměří na specifickou úpravu tohoto fondu ve vztahu k veřejným vysokým školám, kdy v prvé řadě zanalyzuje, zdali a jak veřejné vysoké školy plní povinnost tento fond zřizovat a tvořit. Následně analýzou vnitřních předpisů provede analýzu, na jaké účely se prostředky v těchto fondech používají. Autor vyhodnotí, zdali vysoké školy mají ve svých vnitřních předpisech úpravu souladnou s aktuálním zněním zákona o vysokých školách. Ve vztahu k vysokým školám, které nemají právní úpravu nebo faktickou tvorbu sociálního fondu v souladu se zákonem o vysokých školách navrhne možné postupy nápravy, ať už prostřednictvím Ministerstva školství, mládeže a tělovýchovy, nebo vysoké školy samotné.

Abstract (in English)

One of the amended laws as part of the consolidation package was the Higher Education Act in relation to the social fund. The author will focus on the specific arrangement of this fund in relation to public HEIs, where he will first of all analyze whether and how public universities fulfill the obligation to establish and create this fund. Subsequently, by analyzing the internal regulations, he will analyze the purposes for which these funds are used. The author will evaluate whether HEIs have an arrangement in their internal regulations consistent with the current wording of the Higher Education Act. In relation to universities that do not have legal regulations or the actual creation of a social fund in accordance with the Higher Education Act, he will propose possible remedial procedures, either through the Ministry of Education, Youth and Sports, or the HEI itself.
