Kapitola shrnuje ságu tzv. československých důchodů, spory, které vyvolala mezi vnitrostátními orgány ČR (Ústavní soud, Nejvyšší správní soud, vláda, Parlament) a Soudním dvorem EU. Dospívá k závěru, že důsledky této kauzy byly pouze negativní jak z pohledu aplikace práva EU, tak legitimity všech aktérů a nakonec i postavení osob (penzistů), o jejichž právech bylo rozhodováno.

The chapter summarizes the saga of the so-called Czechoslovak pensions. It analyses the disputes it caused between the national authorities of the Czech Republic (Constitutional Court, Supreme Administrative Court, Government, Parliament) and the Court of Justice of the EU. It comes to the conclusion that the consequences of all the cases were only negative both from the point of view of the application of EU law and the legitimacy of all the actors and finally the status of the persons (pensioners) whose rights were decided upon.
