Abstract

Na jaře 2000 byl přijat zcela nový zákon č. 101/2000 Sb. o ochraně osobních údajů. Tento zákon odstranil mnohé nedostatky, které měla předchozí právní úprava, přičemž vycházel i z nutnosti harmonizovat právní normy v uvedené oblasti s právem Evropské unie. Příspěvek popisuje vybraná ustanovení zákona (zejména ta, která se odlišují od předchozího zákona)z hlediska jeho působnosti, práv a povinností správců a zpracovatelů dat, odpovědnosti za jeho porušení a vztahů k orgánům "datového dozoru".

Abstract (in English)

On spring 2000 the new Personal Data Protection Act (No. 101/2000 Col.) was passed. By this act a lot of failures of the former Act have been removed, while it's depends on necessity to harmonize czech law in this field with EU law. The paper discribes selected parts of the Act (especially the different ones from the former Act) depending on the force, duties and discretio of administrators and executors, responsibility on contravention and relations to the data inspection body.
