Abstract

Monografie se zabývá systémy sociální kontroly, zejména pak právem jako speciálním nástrojem sociální kontroly. Univerzálním prostředkem sociální kontroly je socializace, jejíž částí je i právní socializace, pomocí které si lidé osvojují právní normy.Celá tématika sociální kontroly odráží vztah jedince a společnosti, míru respektu k danému řádu a straně jedné, a míru moci, vynutitelnosti norem chování, na straně druhé. Systémy sociální kontroly slouží ke kontrole chování členů společnosti a sociálních skupin. Právo je pouze jedním ze systémů sociální kontroly, používaným zejména tehdy, když jiné formy selhávají. Tváří v tvář růstu zločinnosti, terorismu a násilí ve světě, ztráty důvěry v sebe i okolí, omezování kvality života, se stále častěji mluví o zintenzivnění kontroly.V současnosti můžeme vidět růst profesionalizace sociální kontroly, medikalizaci a kontrolu pomocí nových technologií.

Abstract (in English)

The Monograph deals with systems of social control oriented at theories in which law is understood to be a specialised tool of social control. A universal means of social control is understood to be socialisation, in the area of law then legal socialisation, which is linked to the establishment of legal consciousness. The whole area of social control can be seen as a relation between an individual and society, the extent of the respect towards a given social order on one side and the extent of power, the enforcement of norms of behaviour, on the other side. Systems of social control are a way, which society uses to influence the behaviour of members of society, or a given social group. Law is only one of possible systems of social control, used in particular when other forms are inefficient or inaccessible. Facing the increase of crime, terrorism and violence in the world, feared loss of trust and limitations to the quality of life, discussions are being held about the need to intensify control. We can see a growing rise of professionalism to be one of the described features of alienation of social control of a human, a return to a medicalization and mainly a big growth of new technologies that are used for observing people.
