V originále
Příspěvek pojednává o terorismu z pohledu českého trestního práva, de lege lata, de lege ferenda. Vysvětluje základní pojmy, jako např. terorismus, teroristický útok, teroristická skupina, včetně jejich forem: mezinárodní, národní, individuální a skupinový terorismus, terorismus jako tzv. ostatní mezinárodní smluvní zločiny. Další část hovoří o platné úpravě (teror, teroristický útok). Druhý případ je důsledkem implementace RR REU z 13. 6. 2002 o boji proti terorismu. V té souvislosti komparuje s českou i slovenskou legislativu proti terorismu. Závěry příspěvku varují před nebezpečím tzv. "fragmentárního přístupu" v různých právních úpravách, jenž může vést k neefektivnímu boji proti terorismu.
In English
This contribution refers to the problem of fighting terrorism from the point of view of the Czech criminal law, both de lege lata and de lege ferenda. It explains the main concepts, such as for example terrorism, terror, terror/attack,terrorist group, including their forms, meaning international, national, individual and group terrorism, terrorism like so/called other international [conventional] crimes. The next part describes legal reagulations of the criminal recourse on terrorism [they are bodies of the crimes terror and terror/attack].The second case is the result of implementation of the Council Framework Decision of date Year 2002 Day 13 Month 6 on fighting terrorism. In this context, a short comparative analysis is given with the Slowak criminal legislation against terrorism. The conclusions of this contribution warn about the danger of a so/called "fragmentary approach" in the different kinds of law, which can result in inefficient fight against terrorism.
