Abstract

Rozpoczęcie dzialałności pierwszego Sądu Konstytucyjnego w 1993 roku. Podstawowe zadania i rosnące orzecznictwo. Tendencje orzecznictwa i doktriny stwarzane Sądem Konstytucyjnym. Rola otoczenia Sądu Konstytucyjnego jak adwokatów i asystentów. Przewrót kpernikański v pojmowaniu prawa jako orędzie pierwszego Sądu Konstytucyjnego - prawo powinno byćże prawo trzeba wykładać w kierunku od porządku konstytucyjnego k ustawom, i nie na odwrót,trzeba ję wykładać nie tylko według jego słów i liter lecz jak składnik wartości konstytutywnych demokratycznego porządku konstytucyjnego.

Abstract (in Czech)

Rozbor základních problémů spojených se zahájením činnosti prvního Ústavního soudu České republiky. Základní úkoly a rostoucí judikatura. Tendence a doktríny Ústavního soudu Role okolí soudu. Koperníkovský obrat v pojetí práva. Právo je třeba vykládat směrem od ústavy k zákonům, je třeba je vykládat ne podle slov a písmen, nýbrž jako součást konstitutivních hodnot demokratického ústavního pořádku.

Abstract (in English)

An analyses of fundamental problems connected with the establishment and beginning of activity of the first Constitutional Court of the Czech Republic. Main tasks and the developing doctrines. Importance of the surround of the Court such as barristers, advisors and assistants. Copernican reversion or revolution in understanding of law in rulings of the Court. The law have to be interpreted from constitution toward ordinary laws and not conversely, not according words and letters, but as a component of constitutive values of democratic constitutional order.
